1. Scope

These Terms and Conditions ("Terms") govern the use of the PetPortrait website and the purchase of products through our platform. By using our website or placing an order, you agree to these Terms.

2. Products & Services

PetPortrait offers:

• Instant Download — AI-generated calendar artwork as digital image files
• Wall Calendar (A4/A3) — Printed calendar with AI-generated artwork, produced and shipped by our print partner Gelato

All calendar artwork is generated by artificial intelligence based on the pet photos you upload. Results may vary and are unique to each generation.

3. Ordering & Payment

• Prices are displayed in EUR and include applicable taxes unless otherwise stated.
• Payment is processed securely through Stripe. We do not store your payment card details.
• A binding contract is formed when you complete the Stripe checkout and payment is confirmed.
• You will receive an order confirmation email with download links (for digital products) or shipping details (for physical products).

4. Delivery

Digital Downloads

Download links are provided immediately after payment via email. Links are valid for 31 days. Please save your files promptly.

Physical Calendars

Wall calendars are printed and shipped by our partner Gelato. Typical delivery times:

• Europe: 5-10 business days
• Rest of world: 10-20 business days

Delivery times are estimates and not guaranteed. Shipping costs are included in the product price.

5. Right of Withdrawal (Widerrufsrecht)

Digital Downloads

By completing your purchase of a digital download, you expressly consent to immediate delivery of the digital content and acknowledge that you waive your 14-day right of withdrawal once the download links are provided. This is in accordance with Article 16(m) of the EU Consumer Rights Directive.

Wall Calendars (Custom/Personalized Products)

Wall calendars are custom-made products, individually printed with your personal pet photos and AI-generated artwork. As personalized goods produced to your specifications, they are exempt from the 14-day right of withdrawal under Article 16(c) of the EU Consumer Rights Directive.

6. Defects & Complaints

If your physical calendar arrives damaged, with print defects, or significantly deviates from the preview shown on our website, please contact us within 14 days of delivery. We will arrange a replacement or refund at our discretion.

7. Intellectual Property

• You retain ownership of the pet photos you upload.
• The AI-generated artwork is created for your personal use. You receive a non-exclusive, non-transferable license to use the generated images for personal purposes (printing, sharing, social media).
• You may not resell, sublicense, or commercially distribute the AI-generated artwork.
• The PetPortrait brand, logo, and website design remain our property.

8. User Responsibilities

• You may only upload photos that you own or have the right to use.
• You may not upload illegal, offensive, or copyrighted content that is not yours.
• You are responsible for providing accurate shipping information for physical orders.
• You may not abuse the generation service (automated scripts, excessive requests, attempts to extract our AI prompts or API keys).

9. Limitation of Liability

• AI-generated artwork is provided "as is". We do not guarantee that the AI output will match your expectations.
• Free previews are watermarked and may differ slightly from purchased high-resolution versions.
• We are not liable for indirect, consequential, or incidental damages.
• Our total liability is limited to the amount you paid for the specific order in question.

10. Data Protection

We process your personal data in accordance with our Privacy Policy and the GDPR as applicable in the EEA/Liechtenstein.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Principality of Liechtenstein. For consumers within the EEA, mandatory consumer protection laws of your country of residence also apply. Any disputes shall be submitted to the competent courts of Vaduz, Liechtenstein, without prejudice to your right to bring proceedings in your country of residence.

12. Changes to These Terms

We reserve the right to update these Terms at any time. The current version is always available on this page. Continued use of our service after changes constitutes acceptance of the updated Terms.
